Before submitting this Waiver, Release and Acknowledgment of Risk Agreement (this "agreement") you must read this agreement carefully. If you do not understand anything in this agreement, or if you object to any provision contained in this agreement you should not sign it and should seek advice from your legal counsel

I affirm that I am participating voluntarily in the dance instruction activities provided by Yavir School of Ukrainian Dance ("Yavir").

I (together with my parent or guardian, if I am under the age of eighteen or under a legal disability) represent covenant and agree, on behalf of myself and my heirs, assigns, and any other person claiming by, under, or through me, as follows:

I acknowledge that participating in dance instruction activities involves certain risks (some of which I may not fully appreciate) and that injuries, death, property damage, or other harm could occur to me or others. I accept and voluntarily incur all risks of any injuries, damages, or harm which arise during or result from my participation in dance instruction activities. I understand and am aware that physical activity, such as participating in dance instruction, is a potentially hazardous activity, and I hereby agree to expressly assume and accept any and all risk.

Accordingly, I agree to waive relinquish, discharge, release, and covenant not to sue Yavir or its parent, affiliated and/or subsidiary corporations or related entities, their members, owners, officers, directors, partners, employees, consultants, contractors, advisors, agents, insurers, attorneys, and volunteers from any and all rights, claims of injury, demands, causes of action, damages, liabilities or loss that I, my minor child/ward, or other family member may have or that may accrue to me, my minor child/ward, or other family members arising out of, connected with, or in any way associated with the dance instruction activities provided by Yavir.

I acknowledge that Yavir is a distinct entity from St. Demetrius Church (135 La Rose Avenue, Etobicoke, ON) and The Ukrainian Catholic Eparchy of Toronto and Eastern Canada (940 The East Mall #201, Etobicoke, ON), their owners, or any other venue that Yavir may choose to conduct dance instruction activities, including online/remote dance instruction activities. As such, I agree to indemnify and hold harmless St. Demetrius Church and The Ukrainian Catholic Eparchy of Toronto and Eastern Canada, their owners, or other such venues, from all losses, liabilities, damages, costs or expenses (including but not limited to reasonable attorneys' fees and other litigation costs and expenses) incurred by St. Demetrius Church and The Ukrainian Catholic Eparchy of Toronto and Eastern Canada, their owners, or other such venues, as a result of any claims or suits that I (or anyone claiming by, under or through me) may bring against St.Demetrius Church and The Ukrainian Catholic Eparchy of Toronto and Eastern Canada, their owners, or other such venues, to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in dance instruction activities.

I have read this agreement thoroughly and fully understand it. I enter into it voluntarily on behalf of myself, my spouse, my heirs, next of kin, assigns, personal representatives, related individuals and related entities. No one has made to me any representations, statements, or inducements that change or modify anything written in this Agreement. If any portion of this agreement shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

By submitting this form, I acknowledge that I understand its content and that this agreement cannot be modified orally.
